1. Introduction

These Terms & Conditions ("Terms") govern the use of EventKick's ("we," "us," or "our" or "platform") services by both Event Organisers ("Organisers") and Event Visitors ("Visitors"). By using EventKick platform services, you are agreeing to be bound by the Terms, together with our Privacy Policy (Privacy Policy).

2. Overview

EventKick provides an online platform that connects Event Organisers with Event Visitors for the purpose of selling and purchasing tickets to events.

3. Payments processing

Payments processing is facilitated by an external payment service provider ("PSP"). EventKick uses Stripe PSP.

Payment processing services for Event Organisers on EventKick are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the "Stripe Services Agreement"). By agreeing to these Terms or continuing to operate as an Event Organiser on EventKick, you agree to be bound by the Stripe Services Agreement, as it may be modified by Stripe from time to time. As a condition of EventKick enabling payment processing services through Stripe, you agree to provide EventKick with accurate and complete information about you and your business, and you authorize EventKick to share this information, as well as transaction information related to your use of the payment processing services provided by Stripe.

When you provide personal data in connection with the Stripe Connected Account, Stripe receives that personal data and processes it in accordance with Stripe's Privacy Policy, which you can see here: https://stripe.com/en-ee/privacy

4. Roles and Responsibilities

Event Organiser

  • Responsible for creating and managing event listings
  • Setting ticket sales targets (expected count of tickets to sell before the event date)
  • Setting ticket prices
  • Delivering the event as described
  • Complying with all applicable laws

EventKick Platform

Acts solely as an intermediary between Organisers and Visitors for ticket sales and payment facilitation. EventKick is not responsible for the quality, safety, legality, or delivery of any event.

Event Visitor

Can use platform to purchase tickets. Should have digital or printed copy of the ticket when entering event location.

5. Ticket Purchase and Payment

  • Ticket prices are set by the Organiser and displayed on the event listing page.
  • All amounts are in EUR, unless otherwise stated.
  • Payment methods available to Visitors depend on the PSP's offerings.

6. Event Cancellation Process

Notification and decision making:

  • EventKick will send an email notification to the Event Organiser if the expected count of ticket sales is not reached 3 days before the event date.
  • The Event Organiser can set the event as cancelled using the website interface. Manual action is needed from the Event Organiser.
  • The Event Organiser reserves the right not to cancel the event even if the sales target is not reached. In this case, organiser should use website to manually set event status as "successfull" and it will be visible publicly.

Consequences of Event Cancellation:

If an Event Organiser sets an event as cancelled:

  • All event visitors will be notified via email about the cancellation.
  • Automatic payment refunds will be triggered for all event visitors.
  • The Event Organiser will not be able to request a payout for a cancelled event.

7. Fees and Pricing

Platform Fees:

  • Trial Plan: EventKick charges 0% platform fee for the Organiser's first event on the platform.
  • Regular Plan: EventKick charges a 3% platform fee on ticket sales, which is deducted from the Organiser's payout.
  • Platform fees are paid by the Event Organiser at the moment of payout.
  • All platform features are available under both pricing plans.

Transaction Processing Fees:

  • Visitors pay transaction processing fees, which vary depending on the chosen payment method.
  • These fees are charged by the external payment service provider and are separate from EventKick's platform fees.

8. Payouts

To receive payouts for ticket sales, Event Organisers must:

  • Complete Know Your Customer (KYC) verification process as required by applicable regulations. KYC process is facilitated by the PSP partner.
  • Configure valid bank account details in their platform user profile.
  • Payout should be requested manually, using EventKick website.
  • Payout can only be requested starting the day after the event's scheduled date.
  • Payout processing times may vary depending on the payment service provider and banking regulations. It can take between 1 to 14 days, depending on the payment method.
  • Actual transfer of the money is facilitated by the PSP partner.

9. Refund Policy

Refunds are only issued if:

  • The event is cancelled by the Organiser.
  • The Organiser agrees to issue a refund in other circumstances (at their discretion).

EventKick is not responsible for:

  • The timeliness of PSP refund processing.
  • Any fees deducted by the PSP or payment method providers.

10. Disclaimers and Limitation of Liability

  • EventKick does not host, manage, or produce any events listed on the platform.
  • The Organiser is solely responsible for event quality, safety, legality, and compliance with applicable laws.

EventKick is not liable for:

  • Cancellation of events by Organisers.
  • Event quality or visitor satisfaction.
  • Losses incurred by Visitors due to event changes, delays, or cancellations.

11. User Conduct

All users must:

  • Provide accurate information during registration and ticket purchase.
  • Not use EventKick for fraudulent purposes.
  • Comply with all applicable laws.

12. Changes to Terms

EventKick may update these Terms from time to time. Continued use of the Ticketing Services after changes indicates acceptance of the updated Terms.

13. Governing Law and Disputes

These Terms are governed by Estonian law. Any disputes will be subject to the exclusive jurisdiction of the courts of Estonia.
